Comet egift card Terms and Conditions
- General Terms
Comet egift cards are issued by Comet Group Limited ("Comet") (registered in England number 278576) whose registered office is at George House, George Street, Hull, East Yorkshire HU1 3AU. These are the terms and conditions ("Ts & Cs") which together with Additional Comet Terms and Conditions referred to on the website (the "Website") apply to your purchase of Comet egift cards from Comet. In the event of any conflict between the on the Website and these Ts & Cs, in connection with the purchase of Comet egift cards, these Ts & Cs shall prevail.
Comet tries to ensure that all information on the Website, including descriptions of the egift cards, are accurate and correct at all times. However, mistakes do happen. Comet will try to resolve all information errors on the Website as soon as reasonably possible, and if Comet reasonably thinks that such an error has affected your purchase of a Comet egift card we will try to let you know. However, because Comet takes these steps Comet will not be liable to you for any errors on the Website.
Comet egift cards are distributed by CashStar Limited (registered in England number 8037226) whose registered office is at Bryan Cave, 88, Wood Street, London EC2V 7AJ ("CashStar").
When we refer to "you" and "your", we mean the user of the Website and purchaser of goods and services including Comet egift cards. These Ts & Cs and the Additional Comet Terms and Conditions on the Website form a legally binding contract between you and Comet. Your acceptance of these Ts & Cs and the Additional Comet Terms and Conditions is made when you buy a Comet egift card. You should read these Ts & Cs and the Additional Comet Terms and Conditions on the Website carefully before you buy anything from the Website.
By visiting the Website, you agree that subject to condition 19 below, the laws of England, without regard to principles of conflict of laws, will govern these Ts & Cs. Comet reserves the right to change these Ts & Cs from time to time in its discretion.
Any such change in these Ts & Cs will be effective to all new purchases for Comet egift cards once such change has been included in the text of these Ts & Cs and published on the Website. You should check the Ts & Cs posted on the Website periodically to ensure that you are aware of and comply with the current version. You make an offer to purchase a Comet egift card from Comet (your "Order") by completing the staged process on the Website as set out below:
It's quick and easy to use, here's how...

- Design your card by choosing one of our images or uploading an image of your own and a personal message of your choice

- Pay and Comet will do the rest
Your Order only constitutes an offer to purchase a Comet egift card from Comet, and does not form a binding contract until accepted by Comet.
On receipt of your Order, you will receive an Order acknowledgement email to the email address which you provide in the Order process. This Order acknowledgement email will contain your Order number, value of the Comet egift card ordered, email address that the Comet egift card has been requested to be delivered to and a delivery date. Note that this email is only to acknowledge that your Order has been received, and is not acceptance by Comet of any offers to purchase an egift card. Comet must receive payment in full for the price of the Comet egift card before we can accept any offers. An offer made by you to purchase a Comet egift card shall only be deemed to be accepted by Comet when CashStar sends you a confirmatory email confirming that the Comet egift card has been delivered.
Comet reserves the right to refuse any offers in an Order prior to acceptance.
If a Comet egift card is delivered with a higher value than the price that was charged to the credit or debit card, Comet reserves the right to cancel the Comet egift card and re-issue a Comet egift card at the correct purchase price.

Comet egift cards may be redeemed for goods and services only in Comet stores. You must take your egift card with you in hard copy or electronic form to the Comet store if you wish to redeem it. Comet egift cards are not redeemable for goods and services purchased on the Comet website or from Comet by telephone. No fees of any kind will be imposed on purchasers or recipients of egift cards.
Comet egift cards may be used as full or part payment for goods or services purchased in Comet stores. No change will be given; any remaining balance will be left on the Comet egift card, and may be spent on future purchases at any Comet store.
Comet egift cards may also be used to pay a deposit on any in-store credit agreement (subject to approval and agreement).
Comet egift cards will expire 24 months after the date of issue and any remaining balance will be forfeited.
Comet shall have the right to reject any damaged, amended, illegible or incomplete Comet egift cards.
- Viewing Balances
To view a Comet egift card balance, follow the instructions below the Comet egift card, on the page linked from the email message which notified you of your gift.
Comet egift cards may not be returned after receipt. Purchasers who wish to cancel a Comet egift card purchase order prior to its delivery to a recipient should contact Customer Support prior to the delivery date selected during the purchase process.
- Lost or Stolen Gift Cards
Comet shall not be liable for any lost, stolen undeliverable or delayed Comet egift cards or any network failure. For more details, please see the FAQs. If you suspect that a Comet egift card has been lost or stolen, contact Customer Support immediately. Comet egift cards will not be replaced if lost or stolen without the purchaser's confirmation email as proof of purchase. Comet egift cards have a cash value and should be treated and safeguarded accordingly.
The maximum value that can be associated with any one Comet egift card is five hundred pounds (£500.00). Total purchases of Comet egift cards for any one individual may not exceed ten thousand pounds (£10,000.00) in one calendar day.
Comet egift cards, even if unused, cannot be reloaded, resold or transferred for value, or redeemed for cash, other gift cards, SMS vouchers or other Comet egift cards or be used as payment on an existing credit agreement, except to the extent required by law.

- Risk of Loss
Ownership and risk of loss of Comet egift cards passes to the purchaser as soon as confirmation of the Comet egift card is sent to the recipient. Please double check the email address of the recipient of the Comet egift card which you enter - it is your responsibility to do so and neither Comet nor CashStar accepts liability if someone other than your intended recipient uses the Comet egift card.

- Payment Methods
Comet egift cards may be paid for with a valid VISA, MasterCard or American Express card.
- Delivery Information and Requirements for Comet egift card Purchasers
All orders for Comet egift cards are subject to a process that compares purchaser information provided on the Website with information about the purchaser provided by the purchaser's financial institution. If there is a discrepancy, the relevant Comet egift card order may be delayed until it can be corrected.
If the required date for delivery of a Comet egift card has passed and confirmation that the Comet egift card was sent has not been received, please contact Customer Support. Please refer to the relevant order number or email address.
Comet shall not be liable for Comet egift cards which are undeliverable or not received due to the failure to enter an accurate email address for the recipient. Please ensure that the email address of the recipient is correct and contact Customer Support if they or the recipient fails to receive his/her Comet egift card. Should an email be returned due to inaccurate delivery information for the recipient, Comet will attempt to contact you for a valid email address.
- Reasons for Failed Delivery
If you have confirmed the recipient's email address but the Comet egift card has not been viewed within a reasonable period after the requested delivery date, the following is a list of the most common reasons why delivery may have failed:
- Spam filter blocked the email or routed it to a bulk/spam folder
- Recipient's firewall blocked the email
- Recipient's email inbox is over size limit
- Recipient's email address is invalid
If a spam filter is blocking email@example.com emails from being delivered to an inbox, the email options will require modification so that firstname.lastname@example.org emails are not treated as spam.

- Personalised Messages and Uploaded Images
If you wish to add a personal message to a Comet egift card, simply type your message in the Message field on the Comet egift card preview.
Personal messages are limited in length to the space provided on the egift card.
There is no additional charge to include a personalized message.
You may upload your own image for display on a Comet egift card. There is no additional charge to do this. As part of the purchase of your Comet egift card, you hereby grant (or, if you are under 18 years old, your parent or legal guardian hereby grants) to Comet and CashStar and their affiliates and agents a nonexclusive, royalty free, worldwide licence to use the uploaded image and personalised message, including all intellectual property rights associated with the uploaded image and personalised message, to create an electronic gift card of the uploaded image and personalised message (the "Licence"). You, (or, if you are under 18 years old, your parent or legal guardian) represent and warrant that (1) the grant of the Licence does not violate the privacy rights, publicity rights, copyrights, trade marks, contract rights or any other rights of any person or entity, (2) neither the uploaded image nor any personalised message is defamatory, indecent, obscene, derogatory, promotes bigotry, racism, hatred, harm or discrimination based on race, gender, religion, nationality, disability, sexual orientation or age, unlawful or contrary to the laws or regulations of any applicable jurisdiction or otherwise inappropriate, offensive or objectionable (2) if you are uploading a company logo or other copyright or proprietary materials, that you are, (or, if you are under 18 years old, your parent or legal guardian is) authorized to grant the Licence to use the uploaded company logo or copyright or proprietary materials to create an electronic gift card, and (3) you have , (or, if you are under 18 years old, your parent or legal guardian has full authority and rights to grant the Licence and to make the representations and warranties contained herein.
Not all personalised messages and uploaded images contained in Comet egift cards are read and viewed, but Comet reserves the right, without notice or explanation, to remove and replace a personalised message or uploaded image which Comet, in its sole discretion, deems potentially unlawful or inappropriate, violates or infringes the rights of a third party, is defamatory, indecent, obscene, derogatory, promotes bigotry, racism, hatred, harm or discrimination based on race, gender, religion, nationality, disability, sexual orientation or age, is contrary to the laws or regulations of any applicable jurisdiction or is otherwise offensive or objectionable and, in so doing, cancel and re-issue any Comet egift card containing such personalised message or uploaded image.

- Force majeure
Neither Comet will not be responsible for the performance of any obligations under these terms and conditions in the case of an event outside of its reasonable control (force majeure), including (but not limited to) strikes, lockouts, failures of third party systems or networks, acts of God, fire, earthquake, storm, flood or other natural disaster, civil unrest, acts of terrorism, deliberate sabotage of or malicious damage to equipment or data or for damage to or destruction of premises or equipment.
All notices which Comet need to give to you under these terms and conditions will be sent by Comet to your email address.
- Entire Agreement
These terms and conditions together with any additional terms and conditions referred to on the Website set out the entire agreement between you and Comet in respect of the sale, purchase and use of Comet egift cards. These terms and conditions supersede any previous agreement or understanding in relation to the subject matter hereof and may only be varied where separately agreed in writing between you and Comet.
If any provision of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions (and the remainder of the provision in question) shall be unaffected.
- Law and Jurisdiction
Save to the extent that you exercise your right as a consumer to bring an action in or rely on the laws of your country of domicile, the interpretation, construction, effect and enforceability of these terms and conditions shall be governed by English Law, and you and Comet agree to submit to the non-exclusive jurisdiction of English courts for the determination of disputes.
